This form allows you to report any infringement and/or irregularity within the scope of application of article 2 of Law 2/2023, dated February 20, regulating the protection of individuals who report regulatory violations and fight against corruption, incorporating Directive 2019/1937 of the European Parliament and of the Council, dated October 23, 2019, regarding the protection of individuals who report violations of Union law.
GRUP BATALLÉ provides different internal communication channels for informants with the intention of facilitating communication and rectifying any irregularity that may occur, taking into account the values and principles guiding our activities, as detailed in our Code of Ethics.
GRUPO BATALLÉ has 'Ethics Channel' mailboxes located at the entrance of the facilities on Avenida dels Segadors, s/n Riudarenes (17421) and in the warehouses located at the Can Pruna Industrial Park, through the corporate website www.batalle.com (the current form), as well as the possibility to provide information directly to the Responsible for the Information System represented by the designated person within the HR Department of the entity through a personal interview and/or telephone call. Additionally, external channels for information are available to competent authorities (Independent Authority for Whistleblower Protection (A.A.I.) or the Office for the Prevention of Fraud in Catalonia) and, where applicable, to institutions, bodies, or organs of the European Union.
By submitting this form, the complaint procedure will be initiated in accordance with what is established in Law 2/2023, with the aim of reporting any irregularities related to our personnel, products, facilities, group image, or any other matter that the complainant deems necessary to be investigated by GRUPO BATALLÉ.
Please be informed that the personal data provided through this form, as well as any data collected during the investigation process, will be processed by the Responsible for the Internal Information System of GRUPO BATALLÉ to fulfill the objectives established in the Ethics Channel and in accordance with Regulation (EU) 2016/679 of April 27, 2016, regarding the protection of personal data and the free movement of such data, as well as Organic Law 3/2018 of December 5, guaranteeing confidentiality and diligent processing.
In the event that the informant or complainant chooses to remain anonymous, they will not receive information regarding the progress of the management, but they can still track their status.
Upon submitting the form, you will receive a reference number assigned to the complaint, allowing you to follow up on the status of the complaint management by the Responsible for the System of GRUPO BATALLÉ.
Once the complaint is received, an initial assessment will be made to determine if it is well-founded or if there are suspicions that it may involve criminal conduct and/or cause harm requiring immediate action to protect the informant, third parties, and the organization itself.
It may be necessary to maintain communication with the informant and request additional information to conduct a diligent investigation. Furthermore, GRUPO BATALLÉ guarantees that both the informant and those affected by the complaint will have the right to preserve their identity, in accordance with article 32 of Law 2/23.
Additionally, informants have a set of rights when the information they provide meets the requirements established in articles 2 and 35 of this Law, including the prohibition of retaliation (article 36). For our entity, the support and protection measures against retaliation provided for in articles 37 and 38 of Law 2/23 are also of great importance.
GRUP BATALLÉ informs the informant that "communicating or publicly revealing false information" is considered a very serious offense, and the Law provides for a fine ranging from €30,001 to €300,000 for individuals who commit it (articles 63.1f) and 65.1.a) of Law 2/23.
Within a maximum period of 7 calendar days from the receipt of the complaint, you will receive an acknowledgement of receipt, except in cases where this could jeopardize the confidentiality of the communication, in accordance with article 9.2.c of Law 2/23.
From that moment, the received communication will be processed, and a maximum period will be determined to respond to investigative actions, which shall not exceed 3 months from the receipt of the communication, except in cases of special complexity where an extension of up to 3 additional months may be necessary.
Regarding the personal data processed, GRUP BATALLÉ informs that they will be kept during the investigation procedure and the processing of any legal proceedings that may arise. Subsequently, they will be destroyed.
